Information Collection Notice For United States Residents

We collect Personal Data from US residents and comply with the consumer privacy laws of California, Colorado, Connecticut, Utah,and Virginia (“US Privacy Laws”). This Detailed US Privacy Notice applies to US residents (“users,” “you,” or “your”). 

For the purposes of this Detailed US Privacy Notice, “Personal Data” means information that is linked or reasonably linkable to a particular individual or household. However, the following categories of information are not Personal Data:

  • Publicly available information;
  • Deidentified or aggregated data; or
  • Information otherwise excluded from the scope of US Privacy Laws.

This Privacy Notice provides the following information to US residents:

  • Categories of Personal Data we collect;
  • Purposes for which we use Personal Data;
  • Categories of Personal Data we disclose to third parties;
  • Categories of third parties to which we disclose Personal Data; and
  • How US residents can exercise their rights under US Privacy Laws:
    • The rights to access, correct, or delete Personal Data; 
    • The right to obtain a portable copy of Personal Data; 
    • The right to limit the use of sensitive personal data in certain circumstances; 
    • The rights to opt out of targeted advertising, sales of personal data, or profiling; and 
    • The right to appeal our decisions about your requests.

Categories of Personal Data

We collect Non-Sensitive Personal Data from the following sources:

  • Directly from our users
  • Inferences from your activity
  • From our business partners
  • From our advertising partners
  • From our web server software

The list below outlines the categories of Personal Data that Everyday Future collects about US residents and how each category of data is disclosed to third parties.

  • Identifiers: Identifiers we collect may contain the following: names, aliases, business or personal address, unique personal identifiers, IP address, email address, account name, and other similar identifiers. This information is used for personalized services, targeted advertising, improvement of our services, compliance with statutory obligations, and analyzing patterns and outcomes for our Recipients in order to improve our products and offerings. This information may be shared with Third Party advertising partners for targeted advertising purposes. This information will not be sold. 
  • Personal Characteristics: Personal Characteristics are personal details, such as race, gender, socioeconomic status about a Recipient.  Everyday Future does not specifically solicit this information from our Users but sometimes Users include it as part of their free form responses to questionnaires or other evaluation services included in our offerings. When this occurs, this information may be shared to Business Clients as part of the business agreement.  This information will not be sold. This information will not be shared outside of the intended purpose. 
  • Commercial Data: If you make a payment for Services, your payment-related information, such as credit card, bank account, or other financial information, may be collected by our third-party payment processor on our behalf. We also store the history of services purchased from us. This information enables Everyday Future to process payments and provide support to current customers. This information will not be sold. This information will not be shared with Third Party advertising partners, and will not be used outside of the intended purpose. 
  • Recording Data: Recording Data may contain the following: Recordings of video meetings, phone calls, voicemails, email exchanges, photographs and recordings from events; Teams/Slack Channels, social media, etc., between Everyday Future and Users. The purpose of this data is for Everyday Future to review the feedback provided by Users; notetaking, responding to support inquiries; using photo and video recordings for future marketing and related business support services. This information will not be sold. This information will not be shared with Third Party advertising partners, and will not be used outside of the intended purpose. 
  • Professional Data: For Recipients we collect information specific to your employment by the Business Client and will share evaluation outcomes with Business Clients and sometimes Contractors to complete specific parts of the contracted work, depending on the project.This information will not be shared with Third Party advertising partners, and will not be used outside of the intended purpose. 

Exercising Your Personal Data Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: sales, identifying the personal information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us, our service provider, or Contractor(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access and Deletion Rights

To exercise the access and deletion rights described above, please submit a verifiable consumer request to us by email at info@myeverydayfuture.com. Only you, or a person authorized to act on your behalf, may make a verifiable consumer request related to your personal information.

You may only make a verifiable consumer request for access or deletion once within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Please be aware that we do not accept or process rights requests through other means (e.g., via fax or social media). If we suspect fraudulent or malicious activity on or from your account, we will delay taking action on your request until we can appropriately verify your identity and the request as authentic. Also note that each of the rights are subject to certain exceptions.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your rights. Unless permitted, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Authorized Agent Requests

You may designate an authorized agent to make a rights request on your behalf. Your authorized agent may submit such a request by following the same method described above. We may require verification of your authorized agent in addition to the information for verification above for US residents and households. Such verification will include written authorization from the consumer for the agent to act on their behalf in making the request or a Power of Attorney.
